1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of rgmusic.pro and any music files purchased through it. By accessing or making a purchase on rgmusic.pro, you agree to be bound by these Terms.

rgmusic.pro is operated by First Rhythmic Gymnastics LLC, a California limited liability company ("RG Music," "we," "us," or "our").

If you do not agree to these Terms, do not use the site or purchase any files.

2. The Service

RG Music is a digital marketplace offering music tracks created for use in rhythmic gymnastics competitions and training. All tracks are AI-assisted compositions with human creative editing and are sold under the license terms described in Section 4.

We reserve the right to modify, suspend, or discontinue the site or any part of it at any time without notice.

3. Eligibility

You must be at least 18 years old to make a purchase on rgmusic.pro. By completing a purchase, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

4. Music Licenses

All music tracks on rgmusic.pro are licensed, not sold. Upon completing a purchase, you receive a limited, non-transferable license to use the track according to the license tier you selected. Ownership of the underlying composition and master recording remains with First Rhythmic Gymnastics LLC at all times.

4.1 Standard License

The Standard License grants you a non-exclusive, worldwide, royalty-free right to use the purchased track for any lawful purpose, including but not limited to:

• Competition routines at any level (local, national, international).
• Training and rehearsal sessions.
• Video recordings shared on social media, YouTube, or other platforms.
• Promotional materials for your club or athletes.

Under the Standard License:

• The same track may be sold to other buyers under a Standard License.
• RG Music makes no guarantee of exclusivity or uniqueness.
• You may not sublicense, resell, or redistribute the track as a standalone audio file.
• You may not claim authorship or ownership of the track.

4.2 Exclusive License

The Exclusive License grants you all rights of the Standard License, plus the following:

• Once your Exclusive License purchase is confirmed, the track is permanently removed from sale to any other buyer.
• No other Standard or Exclusive license for that track will be issued after your purchase date.

Under the Exclusive License:

• You receive the broadest available rights to the track short of copyright assignment.
• You may not sublicense, resell, or redistribute the track as a standalone audio file.
• You may not claim authorship or copyright ownership of the track.
• RG Music retains the right to use the track in its portfolio and promotional materials unless otherwise agreed in writing.

4.3 General License Conditions (Both Tiers)

• Licenses are granted to the individual or organization completing the purchase. They are non-transferable to third parties.
• Use of the track must comply with all applicable laws and competition regulations, including FIG rules where applicable.
• RG Music is not responsible for any copyright claims arising from the use of tracks at competitions or on third-party platforms.
• Licenses are perpetual — they do not expire after purchase.

5. Intellectual Property

All music tracks available on rgmusic.pro, including the underlying compositions and master recordings, are the intellectual property of First Rhythmic Gymnastics LLC. Tracks are created using AI-assisted tools with significant human creative input, including manual editing and arrangement.

You acknowledge that AI-generated works may have limited copyright protection under applicable law. RG Music does not warrant that any track is fully protectable as a copyrighted work. Purchasing a license grants you usage rights as described in Section 4, regardless of copyright status.

The RG Music name, logo, and website content are the exclusive property of First Rhythmic Gymnastics LLC and may not be used without prior written permission.

6. Payments

All purchases are processed securely through Stripe, Inc. RG Music does not collect or store your credit card information. By completing a purchase, you agree to Stripe's Terms of Service at stripe.com/legal.

Prices are listed in US dollars and are subject to change at any time. The price displayed at the time of purchase is the price you will be charged.

7. No Refund Policy

All sales are final. Because our music files are delivered digitally and are immediately accessible upon purchase, we do not offer refunds, exchanges, or cancellations once a transaction is completed.

If you experience a technical issue that prevents you from downloading your purchased file, please contact us at support@rgmusic.pro within 7 days of purchase and we will resolve it promptly. Download links delivered by email are valid for 24 hours from the time of delivery. If your link expires before you are able to download your file, contact support@rgmusic.pro within 7 days of purchase and we will reissue it at no charge.

8. Prohibited Uses

You may not use any track purchased on rgmusic.pro to:

• Resell, sublicense, or redistribute the audio file as a standalone product.
• Claim authorship, copyright, or ownership of the track.
• Use in any context that violates applicable law or promotes illegal activity.
• Synchronize with content that is defamatory, obscene, or harmful.
• Use in any way that could damage the reputation of RG Music or First Rhythmic Gymnastics LLC.

9. Disclaimer of Warranties

RG Music provides all content and services on rgmusic.pro on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the site will be uninterrupted or error-free; (b) any track will meet the specific requirements of any competition or federation; or (c) any track is unique or will not be similar to music available elsewhere.

10. Limitation of Liability

To the fullest extent permitted by applicable law, First Rhythmic Gymnastics LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of rgmusic.pro or any purchased track, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the site or a purchased track shall not exceed the amount you paid for the specific track giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless First Rhythmic Gymnastics LLC and its members, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of any purchased track; (b) your violation of these Terms; or (c) your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of rgmusic.pro shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Santa Clara County, California, under the rules of the American Arbitration Association (AAA). You waive any right to a jury trial or to participate in a class action.

Notwithstanding the foregoing, RG Music reserves the right to seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new Effective Date. Your continued use of rgmusic.pro after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
